Say NO to bill S63.  This is discriminatory legislation that will repeal consumer protections.

Bill S63 BANS consumers from buying from ANY breeder and having the pet delivered via transport truck or airline.

Bill S63 BANS ALL breeders from selling/shipping any pets to consumers in or out of the state. 

Bill S63 PROHIBITS pet shops from purchasing puppies/kittens from ANY and ALL licensed and inspected breeders. 

Bill S63 FORCES pet shops to source ONLY from shelters/rescues, offering ZERO consumer protections.

Bill S63 FORCES consumers to obtain pets only from shelters/rescues, or local breeders, or require the consumer to fly/drive to another state to personally pick up the pet, at greatly added expense to the consumer.  

FACT:  Forcing consumers to spend substantially more money to buy the pet of their choice by requiring them to fly/drive long distances to personally pick up their new pet because S63 bans the ability to have their new pet delivered to them via transport truck or airline is discriminatory against the handicapped, the elderly, and low income households.

FACT: To ban NJ voters from the ability to obtain the pet of their choice from a licensed and inspected breeder of their choice in another state and having it delivered to them via transport truck or airline is discriminatory!

FACT:  Forcing consumers to purchase only local bred pets that may not suit the needs of their family/lifestyle is discriminatory!

FACT:   Forcing consumers to obtain a shelter/rescue pet that may not suit the needs of their family/lifestyle rather than obtaining a pet of their choice from a licensed USDA inspected breeder offered in a pet store is discriminatory!

FACT:  NJ currently offers the strongest consumer protection and animal welfare regulations in the country concerning the sale of pets through pet shops and pet dealers. Unfortunately, while NJ leads the nation in these protections, it is severely lacking in offering even basic and minimum protections regarding shelter/rescue pets and protecting the consumers that choose to adopt.

FACT:  Forcing pet shops to sell only shelter/rescue pets when they are not licensed AND inspected facilities with zero direct violations (like USDA licensed breeders) increases the risk and liability for both the pet shop, the consumer, and the pet.

FACT:  Forcing pet shops to sell only shelter/rescue pets when shelter/rescue pets not required to be examined by a licensed veterinarian at the shelter/rescue to ensure they are healthy prior to adoption increases the risk and liability for the pet shop, the consumer, and the pet.

FACT: Forcing pet shops to sell only shelter/rescue pets when shelters/rescues are not required to provide ANY health/history certificate for the pet to allow transparency increases the risk and liability for the pet shop, the consumer, and the pet.

FACT:  ANY breeder that has five female dogs/cats and ships the pet via transport truck or airline, MUST be licensed by USDA regulations as per congress and the Animal Welfare Act (AWA). Having FIVE dogs is NOT “a large scale commercial kennel” or “puppy mill” as the sponsors wrote in this bill.  To lump ALL USDA breeders as large scale puppy mills is BIGOTED and discriminatory!

FACT:  ASPCA former President Ed Sayres has stated on the record that during his long term of tenure, his organization has NEVER raided, seized or file charges against ANY USDA breeder and he does not believe USDA licensed breeders are “puppy mills”.

FACT:  NJ Pet Shops are currently required by law to buy ONLY from USDA licensed breeders without a single direct violation (ZERO) in the previous two years. That’s right, NJ Pet Shops aren’t allowed to buy from bad breeders! 

FACT:  NJ animal shelters (both public and private) have DOZENS of violations on their inspection reports AND multiple cruelty AND neglect charges against multiple directors/workers in multiple shelters, yet the sponsors of this bill want to force pet shops to obtain pets from shelter sources which have FAR WORSE animal welfare records than USDA licensed breeders! 

FACT:  NJ Pet Shops can purchase pets from more than 82% of ALL licensed USDA breeders because they have ZERO direct violations and two or less indirect violations in the last two years which is required by NJ law known as the Pet Purchase Protection Act.

FACT:  As of June 2016 there are 1931 USDA licensed breeders.  1251 have PERFECT health inspection records with ZERO violations in the last three years!  65% of ALL USDA breeders have ZERO violations going back THREE YEARS. An additional 17% of ALL licensed USDA breeders have only one or two indirect violations within three years. 

NJ Pet Shops can purchase pets from at least 82% of ALL licensed USDA breeders because they have ZERO direct violations and two or less indirect violations in the last three years. NJ law, known as the Pet Purchase Protection Act passed in 2015 requires pet shops to purchase pets only from USDA licensed breeder with zero direct violations and two or less indirect violations in 24 months.  Currently, 82% of ALL breeders licensed by the USDA SURPASS these requirements.

FACT:  Of the 1931 USDA licensed breeders, there was a total of 6292 inspections in a three year period. That equals 3.25 inspections for EACH breeder, representing a minimum of one inspection per year.

FACT:  NJ Pet Shops are currently REQUIRED by law to post on each cage full breeder information AND breeder inspection reports for a 24 month period, as well as an animal history report that includes a NJ licensed veterinarian examination certifying that the pet has been examined and is fit for sale. This provides the consumer full transparency before making a purchase, and to ensure that the pet healthy.

FACT:  NJ Pet Shops are currently required by law to provide health warrantees to provide the consumer with protections in the event that the pet is diagnosed with an illness AFTER going home.  This warranty offers the consumer three different options to choose from, 1. to keep the pet and be reimbursed for ALL vet bills up to DOUBLE the purchase price, 2. to return the pet and receive an exchange pet AND reimbursement of ALL vet bills up to DOUBLE the purchase price, 3. To return the pet and receive a FULL REFUND AND reimbursement for ALL vet bills up to DOUBLE the purchase price.  NJ is the ONLY state and this is the ONLY purchase that allows the consumer to be reimbursed TWICE the cost of the original purchase cost!

FACTS:

Shelter/rescue pets are NOT required to be examined by a licensed NJ veterinarian prior to be offered for adoption.  Pet Shops are!

Shelters/rescues are NOT required to offer ANY consumer protection if the pet is found to be ill after adoption.  Pet Shops are!

Shelters/rescues do NOT have the stringent, consistent, and rigorous inspections to protect the pets in their care. Pet Shops do!

Shelters/rescues do NOT have any sourcing regulations regarding where they obtain their adoptable pets.  Pet shops do!

Shelters/rescues are NOT required to provide documentation as to the source of their pets to provide transparency/ protection. Pet Shops are!

Shelters/rescues are NOT required to provide a health history on the pet to provide the consumer transparency/protections. Pet Shops are!
